Erik Diener
Erik Diener was raised in Carol City, Florida. Thanks to the support of his extended family he was able to attend high school at Chaminade-Madonna College Preparatory in Hollywood, Florida, where he graduated with honors.
Erik moved to Orlando for college and studied accounting at the University of Central Florida, where he graduated magna cum laude. Following college Erik graduated cum laude from Stetson University College of Law in Saint Petersburg, Florida. He also obtained a Master in Business Administration from Stetson University while in law school.
Erik began his legal career as an insurance defense attorney. He represented insurers when they were sued for denying or underpaying claims, provided legal opinions, and trained claims adjusters. Erik represented Citizens Property Insurance Corporation, Southern Fidelity Insurance Company, Capitol Preferred Insurance Company, Castle Key, Homeowners Choice Property & Casualty Insurance Company, Florida Insurance Guaranty Association (“FIGA”), and others while working as an insurance defense attorney.
Erik stopped representing insurers and began representing policyholders as a sole practitioner in 2011. Soon thereafter Erik partnered up with Peter Mineo, Jr., and Peter John Mineo to form The Mineo Diener Law Firm. Erik helped grow The Mineo Diener Law Firm from three attorneys to eleven attorneys before becoming partners with his brother, Warren, and starting The Diener Firm.
Erik is experienced in all stages of the property insurance claim process and property insurance litigation. Erik is also an accomplished appellate attorney.
Warren Diener
Warren Diener was raised in Carol City, a neighborhood in Miami Gardens, Florida. It is from his humble beginnings that he learned the value of hard work and dedication.
Warren obtained his bachelor’s degree in business administration with a major in accounting at the University of Central Florida, where he graduated with honors. After graduating college, Warren attended Stetson University College of Law in St. Petersburg, Florida where he graduated cum laude.
Warren dedicated the first five years of his legal career to construction litigation, helping homeowners resolve and protect their homes from code enforcement and construction liens. He also represented general contractors, subcontractors, and material suppliers in various construction disputes involving payment issues and construction defects.
Each construction case Warren litigated proved to be a unique learning experience that provided an education of various stages of construction, from construction of single-family homes to large scale condominium projects. A large part of this experience included analyzing general contractor’s liability policies, homeowner’s insurance policies, and surety bonds to evaluate possible coverage for construction defects. It is with this invaluable construction experience that Warren partnered up with his brother, Erik, in 2014 to form The Diener Firm, where Warren now focuses his practice on representing Policyholders whose claims have been underpaid or denied.
Daniel Cruz
A dedicated and forceful advocate, Daniel Cruz has been practicing insurance law throughout his career. He spent over 10 years representing insurance companies with respect to residential/homeowner, commercial and marine property damage cases as well as first-party automobile claims.
Now, he represents homeowner and commercial Insureds with claims that have either been denied or underpaid by their insurance carriers.
Dick Ducheine
L. Dick Ducheine was raised in Brooklyn, New York and graduated from Holy Cross Catholic School followed by his attendance at Brooklyn Tech High School. He subsequently moved to New Jersey with his family where he attended the New Jersey Institute of Technology graduating with a degree in Electrical Engineering and a concentration in micro wave fiber optic communications.
He then obtained a Master in Business Administration from Rutgers University with a concentration in finance and finally graduated from Seton Hall University Law in 2006. Mr. Ducheine began his legal career as a contract attorney defending Title 59 Torts Claims with William D. Manns, Esq. representing the City of East Orange, Irvington, Orange, and Newark in New Jersey.
He then relocated to Florida and worked in insurance defense where he represented insurance carriers in first party, general liability, and workers compensation claims. Some of his clients included companies such as Walmart, Citizens, State Farm, QBE, and other insurers. He began working at the Diener Firm, P.A. in 2017 as an associate attorney, and now represents homeowners and mitigation service companies in first party property claims against insurance carriers.
Maria Nieto
Maria Nieto has been practicing in Florida for 27 years. She has a vast amount of experience from the handling of pre-suit matters to trials of matters. She has worked both for the Plaintiff side as well as the Defense side. She prides herself in caring for her clients and providing them with a thorough and well thought out representation and obtaining excellent results for her clients.
Maria has represented insurance companies in the past and is well versed in handling claims effectively to obtain the best outcome for her clients. She is currently specializing in helping Homeowner’s secure the benefits they are entitled to from the insurance companies. Maria Nieto is also a Supreme Court Certified Circuit Civil Court Mediator.
